Activity Release & Concussion Consent
Assumption of Risk. Basketball and athletic activities involve risks that cannot be eliminated — including collisions with other participants, balls, equipment, walls, or the floor; slips, trips, and falls; overexertion; and other risks, known and unknown. These risks can cause serious injury, permanent disability, or death. I understand these risks, I confirm the participant is physically able to take part, and I voluntarily choose to participate or to allow my child to participate.
Release & Agreement Not to Sue. To the fullest extent allowed by Florida law, I — for myself and, if I am signing for a minor, on behalf of my minor child named above, and for our family members, heirs, and representatives — release, discharge, and agree not to sue Above Basketball WGV, LLC and its owners, members, employees, coaches, independent contractors, volunteers, agents, and the owner of the premises (together, the "Releasees") for any claim for bodily injury, illness, death, or property damage arising out of participation in, attendance at, or presence at any ABWGV program, event, or facility, including claims based on a Releasee’s ordinary negligence. This release does not apply to gross negligence or intentional misconduct. For participants under 18: I understand Florida law limits what a parent may waive for a child. For my child, this release waives claims arising from the inherent risks of the activity as described in the Notice below, and I make that waiver knowingly. This release remains in effect for the full duration of the participant’s involvement with ABWGV programs, unless revoked by me in writing.
Medical & Emergency. ABWGV does not provide medical services on site. In an emergency, I authorize ABWGV to call 911 and I consent to emergency medical treatment for the participant if I cannot be reached. I am responsible for all medical costs. The participant will wear any protective equipment required for the activity.
Concussion & Head Injury Information. A concussion is a brain injury caused by a bump, blow, or jolt to the head or body. All concussions are serious, and they can occur in basketball. Signs and symptoms include headache, dizziness, confusion, nausea, balance problems, blurred vision, sensitivity to light or noise, memory problems, and just "not feeling right." Symptoms can appear right away or hours later. Any participant suspected of sustaining a concussion or head injury will be removed from practice or play immediately and may not return until he or she is evaluated and receives written medical clearance from a licensed health care practitioner trained in the diagnosis, evaluation, and management of concussions. When in doubt, we sit them out. I have read and understand this information.
NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF ABOVE BASKETBALL WGV, LLC USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM ABOVE BASKETBALL WGV, LLC IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND ABOVE BASKETBALL WGV, LLC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
I HAVE READ AND FULLY UNDERSTAND THIS RELEASE/WAIVER AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING VOLUNTARILY. A parent or legal guardian must sign if the participant is under 18. Typing your full legal name below is your electronic signature and has the same legal effect as a handwritten signature.
